ARTICLE 1 – SCOPE OF APPLICATION
These General Conditions of Sale (“CGV”) apply, without restriction or reservation to all sales concluded between Madame Laetitia CHINI, individual entrepreneur operating under the commercial name LYSCIE JEWELRY, whose head office is located at 619 Chemin des Broquetiers – 13300 SALON DE PROVENCE, registered with the RCS of SALON DE PROVENCE under number 849 744 883 and any natural or legal person wishing to make a purchase via the Website https://www.lyscie.fr These General Conditions of Sale govern all the necessary steps from placing the order, to payment, to delivery and order tracking. They apply, without restriction or reservation, to all sales of products and services offered on the site. Mrs. Laetitia CHINI, operating under the brand LYSCIE JEWELRY, markets costume jewelry in gold and silver metals. These General Terms and Conditions express the entirety of the obligations and rights of the parties. The Customer acknowledges having read the General Terms and Conditions and expressly declares to accept them without reservation, as long as he checks the box provided for this purpose. Otherwise, the order will not be validated. Madame Laetitia CHINI reserves the right, at any time, unilaterally and without notice, to adapt or modify these General Terms and Conditions according to changes or additions made in order in particular to comply with any new regulations or legislation. Modifications to these General Terms and Conditions are binding on users or Customers from the time they are posted online and cannot apply to transactions previously concluded.
ARTICLE 2 - DEFINITIONS
The terms listed below and used in these General Terms and Conditions meet the following definition:
Customer: Refers to any adult natural person or professional or non-professional legal entity wishing to make a purchase on the Site.
Seller: Refers to Mrs. Laetitia CHINI operating under the brand LYSCIE JEWERLY
Site: Refers to the site accessible at the following address: https://www.lyscie.shop
Articles or Products: Jewelry, ready-to-wear items and accessories for sale on the Site
ARTICLE 3 – FORMATION OF THE ORDER
The Seller offers costume jewelry in gold and silver metals. The order is made by the Customer solely on the information provided on the order form and under his sole responsibility. The Order is formed by the addition of items to the basket by the Customer and its validation. The Client certifies the accuracy of this information. The order must comply with the requirements set out in these General Terms and Conditions. The Customer checks the details and total price of his order. He has the possibility of correcting possible errors before validating it. The order form must be duly completed to be processed. The Customer will receive an order confirmation by email to the email address provided when placing the order.
ARTICLE 4 – PROCESSING THE ORDER
Any order on the Site must be accompanied by the corresponding payment. The Seller will only process the order once full payment has been received and reserves the right to process the order only after verifying the regularity of the payment. If certain Products are not available while the order is being processed, the Seller undertakes to inform the Customer as soon as possible, by telephone, email or post and to indicate to the Customer an availability period. The order processing time may be delayed for the following reasons without incurring the Seller's liability: - Complications in the design of the order;
- Leave;
- Supply order deadlines;
- Other unforeseen and justified circumstances.
ARTICLE 5 – PRICES
The prices mentioned on the order form are in euros. The price of the order corresponds to the fascial value of the Products and the processing and delivery costs of the order. The amount of the total price of the order including the Products as well as processing and delivery costs is stipulated in the order form.
ARTICLE 6 – PAYMENT TERMS
All orders, whatever their origin, are payable in euros. The Customer pays for his order either by Paypal or by Credit Card. The Seller reserves the right to offer only one or more of the payment methods at its discretion. No complaint from the Customer in this regard will be admissible. Payments cannot be subject to any discount. Any dispute over the payment of an invoice must be made in writing within thirty days following its publication, and addressed to the Seller. In the event of late payment, and if he acts within the framework of his professional activity, the Customer will automatically be subject to a late payment penalty of an amount equal to three times the legal interest rate, calculated on the amount of the sum due, as well as a lump sum compensation for recovery costs in the amount of 40 euros, without the need for a formal notice or any reminder. When the recovery costs incurred exceed the amount of this fixed compensation, additional compensation aimed at covering the entire debt recovery procedure costs incurred will be invoiced to the Client. The Seller reserves the right to cancel any order from a Customer with whom there is a payment dispute, without the latter being able to claim any compensation for any reason whatsoever.
ARTICLE 7 - RESERVATION OF OWNERSHIP
The Products ordered will remain the property of the Seller until full payment of their price.
ARTICLE 8 – DELIVERY
Orders are delivered to the address clearly indicated by the Customer when ordering. The Seller reserves the choice of mode of transport.
Delivery times are on average 5 working days for mainland France and 21 working days for the French Overseas Territories from receipt of payment by the Seller. The Seller cannot be held responsible for delays attributable to the carrier, to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
ARTICLE 9 - ACCEPTANCE OF DELIVERY
Any damage noted upon receipt of the package must be the subject of formal and immediate reservations on the delivery note. Failing this, it will be up to the Customer to provide proof that the damage occurred during transport.
Under penalty of inadmissibility, any complaint must be sent to LYSCIE JEWELRY, 619 Chemin des Broquetiers 13300 SALON DE PROVENCE by registered letter with acknowledgment of receipt, with any necessary evidence, within 14 working days following delivery. The return of Products by the Customer following reservations is made under the sole responsibility of the Customer and within 21 days from delivery. Concerning custom or personalized orders, unless the Products were damaged during delivery, no returns or exchanges will be accepted by the Seller. Return shipping costs are the responsibility of the Customer. If the returned item is not in its original condition, any loss of value is the responsibility of the Customer.
ARTICLE 10 – LIABILITY
The Seller, in the online sales process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the internet network such as loss of data, viruses, service interruption or other unintentional problems. The Products are made and assembled by hand in single pieces or in series. As a result, they may present irregularities or some differences in size, color or patterns from one piece to another. The Seller cannot be held liable in this respect.
ARTICLE 11 – GUARANTEES
Any complaint about the Customer's order must be sent by email to the following address: lyscie.creations@gmail.com within a maximum period of 14 days upon receipt of the package. The warranty no longer applies beyond 30 days from the date of receipt. All Products sold by the Seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.
In the event of non-conformity of a Product sold, it may be returned to the Seller who will take it back, exchange it or reimburse it in exchange for a credit on the Site. All complaints or reimbursements must be made by email to the following address: lyscie.creations@gmail.com. Any claim for an order will be impossible beyond 60 days from the invoice date.
ARTICLE 12 – RIGHT OF WITHDRAWAL
In accordance with article L. 221-18 of the French Consumer Code, the Customer has a period of 14 (fourteen) days from the day of receipt of his order to exercise his legal right of withdrawal without having to give reasons. her decision.
If the products may be subject to the legal right of withdrawal, the Customer exercising this right under the conditions provided for in this article in terms of deadline and terms, will be able to obtain, as desired: ·
- a credit note in an amount equal to the price of the returned products, usable only on the Site;
- a refund for returned products.
The full amount paid will be refunded within 90 days of receipt of the products subject to the right of withdrawal. Return costs remain the responsibility of the Customer. Only Products returned on time, in their original packaging and in perfect condition can be refunded. ARTICLE 13 - PERSONAL DATA
The Customer is informed that the collection and processing of personal data concerning him or her is necessary to process the order. In accordance with the “Informatics and Freedoms” law of January 6, 1978 as amended and European Regulation No. 2016/679/EU of April 27, 2016, the Customer has a right of access, opposition, rectification and deletion. information that concerns him. All elements of the Site are sold under the registered trademark LYSCIE CREATIONS, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of the Seller. Any use is subject to the prior written agreement of the Seller. Any hypertext link to the Site and whatever the technique used is strictly prohibited. In all cases, any link must be removed upon simple request from the Seller.
ARTICLE 15 - ENFORCEMENT OF THESE CGV
By signing the order form or confirming the online order, the Customer acknowledges having read these General Terms and Conditions in their entirety and having accepted them without reservation.
ARTICLE 16 - ATTRIBUTION OF JURISDICTION
These General Terms and Conditions are subject to French law. In the event of a dispute relating to the conclusion, execution, interpretation or termination of these General Terms and Conditions, and in the absence of an amicable agreement between the parties, exclusive jurisdiction is granted to the Commercial Court of SALON DE PROVENCE. If the Customer does not have the status of merchant, the rules of common law regarding territorial and material jurisdiction will be applied.
